These terms regulate the distance sale of climate equipment, installation services, and B2B partnerships between Climaeco and customers in Spain and the European Union.

2. Terms and Scope
“Goods” — climate equipment: air conditioners (split systems), heat pumps, solar panels, components, consumables, and accessories.
“Services” — design of climate and energy supply systems, professional installation, commissioning, maintenance, and equipment servicing.
“B2B Partnership / Dealership” — commercial cooperation with legal entities and sole traders (Autónomo) for equipment supply and subcontracting.
“Customer” — individual consumer (B2C) or entrepreneur/company (B2B).
3. Acceptance and Conclusion of Contract
Process: selection of equipment/service → cart or quotation request (presupuesto) → data entry → confirmation of price, taxes, and installation timeline → payment → e-mail confirmation.
Information on steps, contract language, and error correction is provided prior to payment.
In the B2B sector, acceptance of a commercial proposal, service agreement, or order form is permitted.
4. Prices, Taxes, Delivery, Risk
B2C — prices include VAT (IVA); B2B — excluding VAT (when explicitly stated). The final amount includes taxes, delivery, and fees.
The risk of accidental loss or damage passes: in B2B — upon handover to the carrier; in B2C — upon receipt by the buyer or after installation completion by our specialists.
5. Payment and Default
Methods: bank card, transfer, cash/card on local pickup, cryptocurrency, or other methods specified during checkout.
Payment delay exceeding 10 days grants the Executor the right to suspend installation or delivery and charge penalties according to the law.
6. Delivery and Service Timelines
Equipment delivery times are specified in the order. Installation timelines are agreed upon individually and fixed in the quotation or contract.
Delays beyond the Executor’s control (lack of site access, poor weather for high-altitude work) lead to rescheduled timelines without penalties.
7. Right of Withdrawal (B2C) and Exceptions
Consumers have the right to withdraw from a non-defective product within 14 days of delivery (if the item is unused and retains its commercial appearance).
Exceptions: Equipment already installed and integrated into the building’s engineering systems (installed AC units, laid refrigerant lines) is non-returnable due to the irreversibility of the installation. Withdrawal from services is not possible once performance has begun with the customer’s consent.
8. Returns and Warranty Procedure (RMA)
Requests for return or warranty repair must be sent via e-mail with the order number, photo/video evidence of the issue, and a description of the reason.
Upon confirmation, a case number is issued along with the return address for uninstalled equipment (if applicable): Carrer Nou d'Octubre, 37, bajo, 46702 Gandia (Valencia, Spain).
Refunds for unused goods are processed using the original payment method within the statutory period.
9. Warranties and Compliance
The legal warranty in Spain is 3 years for climate equipment (from the manufacturer).
For installation work performed, Climaeco provides its own warranty (the term is specified in the completion certificate).
The commercial warranty does not diminish or replace the legal one.
10. Infrastructure, Installation, and Permits (Important)
The customer must ensure site access, availability of required power supply, and a prepared installation area.
Permit Responsibility: The customer is solely responsible for obtaining all necessary permits from the building community (Comunidad de propietarios) or municipality for installing outdoor AC units or solar panels on facades/roofs.
If hidden defects in walls or electrical wiring are discovered during installation, additional work will be charged separately.
11. Maintenance and Operation
Warranty is void in case of: unauthorized equipment opening, third-party repairs, mechanical damage, power surges, or lack of regular maintenance (e.g., filter cleaning).
Consumables (filters) and natural wear and tear are not covered by the warranty.
12. Intellectual Property
Trademark, website design, texts, and documentation belong to Climaeco or its suppliers. Copying materials without written consent is prohibited.
13. B2B Partnership and Dealership
13.1. Cooperation Terms
We offer special conditions for construction companies, interior designers, and independent installers (Autónomo) for wholesale purchases of climate technology.
13.2. Dealer Discounts and Standards
Partner status provides access to wholesale price lists. Partners agree to comply with manufacturers' technical regulations when reselling and installing equipment.
13.3. Territory and Sales Channels
Exclusive supply conditions for specific regions in Spain may be available for large distributors.
13.4. Partnership Types
Basic Dealer: Wholesale purchase without installation obligations. Access to B2B portal, technical catalogs, and consultations.
Certified Installation Partner: Assignment of installation orders in the partner’s regions. Mandatory training and quality control by Climaeco.
Project Support: Joint implementation of large-scale projects (industrial HVAC, solar plants). Engineering, supply, and supervision.
14. Liability
The Executor’s liability is limited to the order amount. Indirect damages (e.g., damage to interior finishes due to hidden wall defects) and loss of profit are excluded. Liability for intent, gross negligence, death, or personal injury is not limited by law.
15. Force Majeure
Factors beyond reasonable control (natural disasters, global supply chain disruptions, logistics strikes) exempt the parties from liability for delayed performance while the factor persists.
16. Disputes and Jurisdiction
B2C — complaint procedure and consumer dispute resolution platforms (ADR/ODR). B2B — negotiations; failing agreement, courts at Climaeco's place of registration. Consumers retain the right to seek recourse in the courts of their place of residence.
17. Governing Law
Spanish law and mandatory EU regulations regarding consumer rights and e-commerce apply.
18. Amendment of Terms
The version published on the website at the time of order prevails. For paid orders and signed B2B contracts, changes are only possible by mutual agreement.
